Introduction: 
 
This Terms of Service hereby referred to as ("TOS") is a legally binding agreement that governs your use of "virtual goods and services" hereby referred to as ("Services") provided by Tantra-Extreme hereby referred to as ("S-E").  By accessing or using these Services and or virtual goods you agree to the following TOS. 
 
 
 
Modification of TOS: 
 
TE reserves the right to modify the TOS at any time.  
 
When we modify the TOS, we may notify you. However, TE is not obligated to notify you of changes providing the changes are made publicly accessible at http://www.servers-extreme.com/tos/ 
 
You agree to periodically check the link http://www.servers-extreme.com/tos/ that will contain this document and read any messages TE sends to you regarding the TOS. 
 
Your continued use of the Services after the TOS have been modified constitutes your agreement with the modified TOS. 
 
 
 
License to Use the Services: 
 
Subject to your compliance with these TOS, you may use the Services solely for your own non-commercial entertainment purposes.  You may not use the Services for any other purpose. 
 
You may not copy and distribute the content of the Services. 
 
TE reserves the right to discontinue the Services or to change the content of the Services in any way and at any time, with or without notice, without liability. 
 
You agree to follow any rules within the applications or forums of the Services, any game-specific rules associated within the Services, and the rules and conditions outlined in the TOS. 
 
You must be 13 year of age or older to purchase the Services. 
 
If you are between the ages of 13 and 18, inclusive, you represent that your legal guardian has reviewed the TOS and has given you permission to purchase the Services. 
 
If your use of the Services is in violation of the TOS, TE reserves the right to terminate your access to the Services without notice without refund.  
 
Ownership of Intellectual Property: 
 
All accounts and Services provided by TE are owned by them. 
 
You do not acquire any rights of ownership to any part of the Services by using the Services, downloading material from the Services, adding material to the Services, or by purchasing any Virtual Goods within the Services. 
 
You agree to not copy, publish, redistribute, or make use of any material on the Services without prior written permission from TE. 
 
 
 
Limitations of Use: 
 
 
You agree that you will not: 
Engage in or promote any illegal activity such as hacking the Services, cheating, or using any software such as "bots" or other applications that are designed to change the experience of the Services. 
 
Upload to the servers used by TE to provide these Services any software or application that will damage the Services or alter the operation of the Services. Examples of such software or applications are, but are not limited to, Trojan horses, viruses, worms, time bombs, and corrupted files. 
 
Except as allowed by applicable law, copy, reverse engineer, modify, disassemble, or decompile, in whole or in part, or create derivative works of the Services. 
 
Post any content to any part of the Services that: 
 
Is unlawful; 
 
Is offensive and related to race, national origin, sexual preference, sex, or physical handicap; 
 
Is profane, obscene, pornographic, or sexual in nature; 
 
Harasses, intimidates, libels, mocks, or threatens other users or persons; 
 
Is violent in nature or promotes violence; 
 
Promotes the use of drugs or other illegal substances; 
 
Is not related to the Services, such as, but not limited to, surveys, contests, or spam; 
 
Advertises or promotes the selling or buying of any goods or services; and, 
 
Infringes on the rights of other parties, including, but not limited to, intellectual property rights, contractual rights, and personal rights. 
 
 
Engage in activities on the Services that: 
 
reveal the personal information about another user, except information that is publicly available; 
 
misleads TE or others by creating false user accounts or by trying to learn private information; 
 
improperly use the S-E support services by submitting reports or misuse or misconduct that are not true; 
 
harm, tarnish, or disparage, in TE's opinion, TE or the Services; 
 
copy or adapt any of the software associated with the Services, including, but not limited to, PHP, HTML, Flash, Javascript, JAVA, or other code; and, 
 
reverse engineer, decompile, reverse assemble, attempt to discover any software code (including source code or object code) that are used by the Services to transmit and render web pages or any other processes or products accessed through the Services. 
 
These examples of improper conduct are not meant to be exhaustive and TE reserves the right to determine what conduct it considers to be inappropriate or otherwise not in the spirit of the Services. 
 
Violations may lead to termination of your account and being banned from further access to the Services. 
 
TE does not control, monitor, or endorse content posted by users to the Services or of external websites that are linked to the Services. TE, therefore, does not assume any responsibility for this content. 
 
 
 
Posting on Other Web Sites: 

You are granted a limited revocable license to post an image or screen shot from the Services that is related to your use of the Services (your character, for example) within the Services. Additionally, where TE specifically gives you permission to do so, you may post images or screen shots from the Services that are related to your use of the Services and other materials that TE specifically permits to be posted to third-party websites provided: 
 
the website is not competing with TE; 
 
the website does not criticize or injure TE; 
 
the website does not obtain any rights to the material posted other than the right to post it at your discretion; 
 
the website does not charge for access to the content; and, 
 
the website complies with all applicable laws; does not abuse or violate the right to privacy, intellectual property, or the legal rights of others; does not publish or distribute material that is inappropriate, infringing, indecent, pornographic, illegal, or otherwise objectionable. 
 
 
TE expressly reserves its rights and remedies and may revoke this limited license, in whole or in part, with notice. 
 
 
 
User Content: 
 
Content, such as text, images, comments suggestions, or any other material that a users posts to the Services ("User Content") will be treated by TE as public information that is neither confidential nor proprietary. 
 
You agree that you own the rights to any User Content you post to the Services. 
 
Upon posting User Content to the Services, you grant TE a non-exclusive, unlimited, unconditional, irrevocable, perpetual, fully-paid and royalty-free right and license to use that User Content as TE sees fit via any medium. 
 
TE does not have the obligation to monitor or enforce any intellectual property rights associated with User Content. However, TE does have the right to enforce intellectual property rights. 
 
TE has the right to delete User Content from the Services or to modify User Content on the Services as it sees fit at any time without notice. TE has the obligation to enforce the rights of third parties when violations to intellectual property rights are brought to its attention, per the section in the Terms titled Digital Millennium Copyright Act. 
 
Offensive User Content should be reported to TE through the support system in the Services. While TE has the right to remove any User Content it deems objectionable, it is not obligated to do so. 
 
 
 
Virtual Currency and Virtual Goods: 
 
The Services may include points, gold, cash, or other means of exchange within the Services ("Virtual Currency") and virtual items, such as favors, gems, components, and units ("Virtual Goods") that can be purchased within the Services using actual, real currency. 
 
Users have the right to use Virtual Currency and Virtual Goods within the Services as they are intended to be used. Users do not have any other rights to Virtual Currency or Virtual Goods associated with the Services. 
 
TE has the sole and absolute right to manage, modify, create, and delete Virtual Currency and Virtual Goods associated with The Services. 
 
The Virtual Currency and Virtual Goods associated with the Services may not be sold, traded, exchanged, or transferred outside of the Services. The Virtual Currency and Virtual Goods associated with the Services may not be exchanged for actual, real currency from either TE or from any other party. Violations may lead to termination of your account and being banned from further access to the Services. 
 
All sales of Virtual Currency and Virtual Goods associated with the Services are final. TE is not obligated to refund money spent for Virtual Currency or Virtual Goods. If a user is terminate from one or more of the applications associated with the Services, no refund will be given. No refund will be given if TE stops providing any or all of the Services. 
 
 
 
Disputes with Other Users: 
  
TE may monitor and manage disputes between users. However, TE does not have the obligation to do so. TE assumes not liability for disputes between users. Further, you agree to release TE and agree to indemnify TE from any and all claims, demands, or damages related in any way to such disputes. 
 
 
 
Links to Third-Party Websites and Applications: 
 
TE may provide links to third-party websites or embed third-party applications with the Services for the purpose of offering users promotions. These promotions make available optional services, upgrades, and in-game Virtual Goods. These third-party websites may charge additional feed and have their own terms of service and privacy policies. Third-party websites may collect personal information from users. TE does not warrant the content or the goods and services provided by any third-party website. TE is not responsible for the content, policies, or the business practices of third-party websites or the collection or use of personal information by third-party websites. TE is not liable for any claim related to third-party websites. 
 
 
 
Termination: 
  
TE reserves the right to terminate or suspend your access to any or all of the Services if it determines that you have violated these TOS. In the event your access to the Services is terminated, you will not be entitled to a refund or credit for any points, items, Virtual Currency, or Virtual Goods. 
 
 
 
Limits of Liability: 
 
The Services are provided on an "As Is" basis. The Services are provided without any warranties of any kind, including warranties expressed or implied. There is no warranty, without limitation, of merchantability or fitness of the Services for any particular purpose or use. There is no warranty of non-infringement. TE does not warrant that the Services will be error-free or uninterrupted. You agree that your use of the Services is at your own risk. Neither TE, its employees, its contractors, nor its partners are responsible for damages or loss of any kind, either within the Services or personal damages or losses resulting from the use of the Services or from the inability to use the Services. 
 
 
 
Indemnification: 
  
You agree to indemnify, defend, and hold TE harmless against any claims, losses, liability, damages, or expenses incurred by TE as a result of you access to or use of the Services, or any violation of the TOS. You agree that such indemnification will continue after you have stopped using the Services. 
 
 
 
Waiver and Severability: 
  
The failure of TE to enforce any right or provision of these TOS will not be construed to be a waiver of the right or provision. 
 
In the event that any provision of these TOS is held to be invalid or unenforceable by a court of law, the remaining provisions of these TOS will remain in full force and effect. 
 
 
 
Other Jurisdictions: 
  
TE is located in the Argentina. TE does not claim that the Services are appropriate for use in other countries. The Services are not intended to be distributed to countries where such distribution is contrary to the laws and regulations of the United States. The Services are not intended to be distributed to countries which require registration of the Services or of TE. 
 
 
 
Entire Agreement: 
  
These TOS are the entire agreement between TE and you regarding the Services. These TOS replace any TOS that preceded it.

Introducción:

Estas Condiciones de servicio entendidas como ("TOS") son un acuerdo jurídicamente vinculante que rige el uso de "bienes y servicios virtuales" por este medio. Esto se refiere a los ("Servicios") proporcionado por Tantra-Extreme denominados ("TE"). Propiedad de la Propiedad Intelectual:

Limitaciones de uso:

Usted acepta que no podrá:

1. Participar o promover cualquier actividad ilegal como el pirateo de los Servicios, el engaño, o utilizar cualquier software como "robots" u otras aplicaciones que están diseñadas para cambiar la experiencia de los Servicios.

2. Proveer servicios, software o aplicaciones que puedan dañar o modificar los Servicios de SE o el funcionamiento de los mismos.

3. Proporcionar ejemplos de software o aplicaciones, que contengan troyanos, virus, gusanos, bombas de tiempo, y archivos dañados.

4. Con excepción de lo permitido por la ley aplicable, copiar, realizar ingeniería inversa, modificar, desensamblar, descompilar en todo o en parte, o crear trabajos derivados de los Servicios.

Publicar cualquier contenido en cualquier parte de los Servicios que:

1. Sea Ilegal;

2. Ofensivo, racista, de discriminación de origen nacional, preferencia sexual, sexo o discapacidad física.

3. Profano, obsceno, pornográfico o de naturaleza sexual;

4. Acose, intimide, se burle, o amenace a otros usuarios o personas;

5. Sea violento por naturaleza o promueva la violencia;

6. Promueva el uso de drogas u otras sustancias ilegales;

7. No esté relacionada con los Servicios, por ejemplo, encuestas, concursos, o spam ajeno a SE;

8. Anuncie o promueva la venta o compra de cualquier bien o servicio,

9. Infrinja los derechos de otras partes, incluyendo pero no limitado a, los derechos de propiedad intelectual, derechos contractuales, y los derechos personales.

Participar en las actividades de los Servicios que:

1. Revelen la información personal de otro usuario, salvo la información que esté disponible al público;

2. Inducir al error a los demás mediante la creación de cuentas falsas de usuario o al tratar de obtener información privada;

3. Utilizar indebidamente los servicios de apoyo TE mediante la presentación de informes o el mal uso o mala conducta o conductas y casos que no son ciertos;

4. Dañar, empañar, o menospreciar a SE y/o sus Servicios;

5. Copiar o adaptar alguno de los programas informáticos asociados con los Servicios, incluyendo pero no limitado a, PHP, HTML, Flash, JavaScript, Java o cualquier otro código, y,

6. Utilizar técnicas de ingeniería inversa, descompilar, desensamblar, intentar descubrir cualquier código de software (incluyendo el código fuente o código objeto) que son utilizados por TE para transmitir y hacer páginas web o cualquier otro proceso o producto ajeno.

Estos ejemplos de conducta inapropiada no pretenden ser exhaustivas y TE se reserva el derecho de determinar qué conducta se considera inapropiada o cuál no.

Éstas y otras violaciones que se determinen, puede dar lugar a la terminación de su cuenta y a la prohibición posterior del acceso a los Servicios.

TE no tiene control, del contenido publicado por los en sitios web externos que están vinculados a los Servicios de la comunidad. TE, por lo tanto, no asume ninguna responsabilidad de este contenido.

La publicación en los otros sitios web:

Se concede una licencia limitada y revocable para publicar capturas de pantalla, imágenes y otros materiales relacionados con los servicios que brinda TE siempre y cuando TE específicamente le de permiso para hacerlo. Además, el sitio web:

1. No debe competir con TE.

2. No debe criticar o o herir a TE;

3. No debe cobrar por el acceso a los contenidos, y,

TE se reserva expresamente los derechos y recursos y puede revocar esta licencia limitada, en todo o en parte, con previo aviso.

Contenido de Usuario:

1. Contenido, como texto, imágenes, comentarios, sugerencias, o cualquier otro material clasificado como “Contenido de Usuario" será tratado por TE como la información pública que no es ni confidencial ni de propiedad.

2. Usted acepta que es dueño de los derechos de cualquier Contenido de Usuario que publique en los Servicios.

3. Al publicar Contenido de Usuario al interior de los Servicios, usted concede a SE una licencia no exclusiva, ilimitada, incondicional, irrevocable, perpetua, totalmente pagada, libre de regalías, y con licencia de uso de dicho Contenido a TE para que ésta haga uso como considere oportuno a través de cualquier medio.

4. TE no tiene la obligación de supervisar o hacer valer cualquier derecho de propiedad intelectual relacionados con el Contenido de Usuario. Sin embargo, TE tiene el derecho de hacer valer los derechos de propiedad intelectual.

5. TE tiene el derecho de eliminar Contenido del Usuario de los Servicios o modificar el Contenido de Usuario en los Servicios que estime conveniente en cualquier momento sin previo aviso ya que SE tiene la obligación de hacer cumplir los derechos de terceros cuando hayan violaciones a los derechos expuestos en este documento.

6. Contenido considerado como ofensivo debe ser informado a TE a través del sistema de apoyo en los Servicios. Sin embargo, y aunque TE tiene el derecho a eliminar cualquier Contenido de Usuario que considere objetable, no está obligado a hacerlo.

De moneda virtual y Virtual Producto:

1. Los servicios pueden incluir puntos, dinero en efectivo, u otros medios de intercambio ("moneda virtual") así como joyas, componentes y unidades ("Virtual Goods") que se puede comprar utilizando moneda real.

2. Los usuarios tienen el derecho a utilizar divisas y bienes virtuales dentro de los Servicios, ya que están destinados a ser utilizados.

3. TE tiene el derecho exclusivo y absoluto para gestionar, modificar, crear y eliminar las divisas y bienes virtuales asociados a los servicios.

4. La moneda y bienes virtuales asociados a los servicios no pueden ser vendidos, intercambiados o transferidos a otras comunidades o fuera de los Servicios. La moneda virtual y bienes virtuales asociados a los servicios no pueden ser cambiados por dinero real, ya sea TE o de cualquier otra parte. La violación a éstos términos puede dar lugar a la terminación de su cuenta y con la prohibición del acceso posterior a los Servicios.

5. Todas las ventas de moneda virtual y bienes virtuales asociados con los Servicios son finales. TE no está obligado a reembolsar el dinero gastado en divisas o bienes virtuales. Si un usuario termina con una o varias de las aplicaciones asociadas a los servicios de TE, no habrá devolución de dinero. Tampoco habrá devolución si TE deja de prestar cualquiera o todos de sus Servicios.

Las disputas con otros usuarios:

TE puede controlar y gestionar los conflictos entre los usuarios. Sin embargo, no tiene la obligación de hacerlo. TE no se hace responsable de las controversias entre los usuarios. Además, usted está de acuerdo para liberar a TE de indemnizaciones, reclamos, demandas o daños relacionados de alguna manera con dichas disputas.

Enlaces a sitios web de terceros y aplicaciones:

TE puede proporcionar enlaces a sitios web de terceros o incrustar aplicaciones de terceros con los Servicios con el fin de ofrecer a los usuarios promociones. Estas promociones ponen a disposición de los servicios opciones de complemento a los servicios existentes. Es de aclarar que estos sitios web de terceros tienen sus propios términos de servicio y políticas de privacidad y pueden recopilar información personal de los usuarios.

TE no garantiza el contenido o la calidad de los productos y servicios prestados por cualquier sitio web de terceros. Por tal razón no se hace responsable por el contenido, políticas o prácticas comerciales de los sitios web de terceros así como tampoco de la recaudación y uso de información personal por dichos sitios. En ese orden de ideas SE no se hace responsable de cualquier reclamo relacionado con sitios Web de terceros.

Terminación:

TE se reserva el derecho de terminar o suspender su acceso a cualquiera o todos los Servicios si se determina que usted ha violado estas Condiciones de servicio. En el caso que esto suceda, usted no tendrá derecho a un reembolso o crédito ni de sus divisas ni de sus bienes virtuales.

Límites de responsabilidad:

TE no garantiza que los Servicios estén libres de errores o interrupciones. Usted acepta que el uso de los Servicios es bajo su propio riesgo. Ni TE, sus empleados, sus contratistas, ni sus socios son responsables por los daños y perjuicios de toda naturaleza, que usted llegue a tener por la utilización de nuestros servicios o, en su defecto, por la imposibilidad de utilizarlos.

Indemnización:

Usted acepta indemnizar, defender y mantener indemne a TE en contra de cualquier reclamo, pérdida, responsabilidad, daños, o gastos incurridos por TE como resultado del acceso o uso de los Servicios. Además, usted acepta que dicha indemnización se continúa después de haber dejado de utilizar los Servicios.

Renuncia e independencia:

El fracaso de TE para hacer valer cualquier derecho o disposición de estas Condiciones no se interpretará como una renuncia a sus actividades, derechos y deberes.

En el caso de que cualquier disposición de estas Condiciones se considera inválida o inejecutable por un tribunal de justicia, las restantes disposiciones de estas Condiciones de servicio permanecerán en pleno vigor y efecto.

Otras jurisdicciones:

TE se encuentra en Argentina y no tiene la pretensión de que los servicios sean apropiados para su uso en otros países. Los servicios no están destinados a ser distribuidos a los países donde dicha distribución es contraria a las disposiciones legales y reglamentarias de los Estados Unidos. Los servicios no están destinados a ser distribuidos a los países que requieren el registro de los Servicios o de TE.

Acuerdo completo:

Estas Condiciones de servicio constituyen el acuerdo completo entre Tantra Extreme y usted con respecto a los Servicios.
